These Terms of Service (Terms) govern your use of the HaltH platform, which consists of our website and mobile applications (Platform). HaltH Pty Ltd (ABN 80 678 292 165) (HaltH, we, us, or our) provides the Platform. In these Terms, a reference to you or your means you as the user of our Platform. Please read these Terms carefully. By accessing or using the Platform, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree to these Terms, you must not use the Platform.

The Platform is not designed for emergency or acute medical situations.

1. Your Access to the Platform

1.1 Licence to Access

By accepting these Terms, we grant you a limited, non-exclusive and revocable licence to access and use the Platform.

1.2 Account Registration

To use certain features of the Platform, you may need to create an Account. When creating an Account, you must:
  • provide accurate and complete information
  • keep your Account information up to date
  • maintain the security of your Account credentials
  • notify us immediately of any unauthorised access to your Account
You are responsible for all activity that occurs under your Account.

1.3 Age Restrictions

You must be at least 16 years old to create an Account and use the Platform. If you are under 16, you may only use the Platform with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

1.4 Access for Others

If you create an Account or make bookings on behalf of another person (such as a family member), you:
  • confirm that you have authority to act on behalf of the other person, including consent to share their Personal Data with us and the Health Provider
  • warrant that you have authority to bind that person to these Terms
  • agree that both you and the person you act for will be bound by these Terms

2. Using the Platform

2.1 Acceptable Use

When using our Platform, you agree that you will:
  • comply with these Terms and all applicable laws
  • provide accurate and complete information when booking appointments
  • respect appointment times and cancellation policies of Health Providers
  • only use the Platform for its intended purpose

2.2 Prohibited Activities

You must not:
  • provide false or misleading information
  • use the Platform in any way that could damage, disable, overburden, or impair its functioning
  • attempt to gain unauthorised access to any part of the Platform
  • transmit viruses, malware, or harmful code
  • record, publish or share any telehealth consultation without explicit permission
  • engage in unlawful, defamatory, obscene, threatening, or harassing conduct
  • impersonate any person or entity

2.3 Bookings and Appointments

When you make a booking through our Platform:
  • you are responsible for attending the appointment or cancelling within the Health Provider’s cancellation policy
  • appointment availability is subject to change until confirmed by the Health Provider
  • you authorise us to send appointment confirmations, reminders and related communications
  • you acknowledge that the Health Provider may have additional requirements or policies

2.4 Health Fund Claiming Estimates

If you use the Platform to receive health fund claiming estimates:
  • these are estimates only, provided by your Health Fund and/or the Health Funding Partner
  • we are not responsible for discrepancies between the estimated and actual rebate amounts
The Platform may integrate with third party services, including payment processors, health funds and Health Providers’ systems. Your use of these services is subject to their terms. The Platform may contain links to third party websites. We do not endorse or control these sites and are not responsible for their content or privacy practices.

3. Payments and Health Funding details

3.1 Payment Card Information

When you provide payment card details through the Platform:
  • you authorise us to store and process your payment information through our Payment Processor
  • your card details may be securely tokenised and saved for future bookings
  • you authorise the Health Provider to charge your stored payment method for appointment fees, cancellation fees or no-show fees
  • you confirm that you are authorised to use the payment method provided

3.2 Fees Payable to Health Providers

Fees for healthcare services are set by the Health Provider, not by HaltH. We only facilitate the payment process.

3.3 Payments and Refunds through the Platform

You acknowledge that:
  • Health Providers can charge your payment method using the Platform
  • payments are processed by Payment Processors
  • refunds are subject to the Health Provider’s refund policy and will be issued to the original payment method

3.4 Health fund details

When you provide your Health Funding Details through the Platform: (a) you authorise us to store and process those Health Funding Details (including through our Health Funding Partners or directly through applicable government systems) for the purpose of facilitating health funding claims, rebate processing and related transactions in connection with the Platform; (b) your Health Funding Details will be securely tokenised, saved to your Account and may be used for future claims, rebates or transactions you make through the Platform or with any Health Provider in the HaltH network (even if those interactions are not made directly through the Platform); (c) you acknowledge that your Health Provider may use your stored Health Funding Details to facilitate the submission of claims or processing of rebates through our Health Funding Partners or applicable government systems, in accordance with relevant claiming requirements; (d) where a Provider adds or updates your Health Funding Details (for example, using tap-to-pay at checkout), the Provider must first obtain your consent. HaltH is not responsible for any failure by the Provider to do so.

4. Privacy and Data

4.1 Collection and Use of Your Data

We collect and use your Personal Data in accordance with our Privacy Policy. By using the Platform, you consent to our collection, use, and disclosure of your Personal Data as described in the Privacy Policy. This may include collecting and storing your Health Funding Details to facilitate claims, rebates and related transactions as set out in these Terms.

4.2 Sharing Your Information

We may share your Personal Data with:
  • the Health Provider you book with
  • our Payment Processor
  • our Health Funding Partner and your Health Fund
  • other parties as described in the Privacy Policy

4.3 Communications

By using the Platform, you consent to receiving communications from us, including:
  • appointment confirmations and reminders
  • booking updates
  • health fund claim information
  • Platform updates
  • marketing communications (you can opt out at any time)

4.4 Security and Data Transmission

We take reasonable steps to protect your data, but the internet is not completely secure. You accept the risks associated with online data transmission.

4.5 Data Retention

We may limit the amount of data you store on the Platform. We perform reasonable backups but do not guarantee recovery of specific data unless stated in writing.

5. Our Responsibilities

5.1 Providing the Platform

We will make reasonable efforts to keep the Platform available, but we do not guarantee uninterrupted or error-free access. We may suspend access for maintenance.

5.2 Platform Only

We are a platform provider only. We are not a healthcare provider, payment processor, or health fund. (a) All healthcare services are provided by the Health Provider, not by HaltH. We are not responsible for the healthcare services provided to you. (b) Payment processing is handled by our Payment Processors, not by HaltH. (c) The health funding claims service and rebate service available through the Platform are provided to Health Providers, and any estimates, submissions or processing of rebates or claims provided through the Platform are processed by our Health Funding Partners or applicable government systems, and by your Health Fund or other payer, not by HaltH. We do not verify claim information, process claims, or have any control over claim submissions, outcomes, eligibility, or payment amounts.

5.3 No Medical Advice

The Platform does not provide medical advice. Information provided is general only and not a substitute for professional medical advice.

6. Intellectual Property

6.1 Our Intellectual Property

All intellectual property in the Platform is owned by or licensed to HaltH. You receive only a limited licence to use the Platform.

6.2 Restrictions

You must not:
  • copy, modify, adapt or create derivative works
  • use automated tools to extract data
  • reverse engineer, decompile or disassemble any part
  • remove or obscure proprietary notices
  • reproduce, distribute, license or exploit Platform content

6.3 Your Contributions

You grant us a royalty-free, irrevocable, worldwide licence to use any contributions you make to the Platform, including ideas, suggestions or feature requests.

7. Limitation of Liability

7.1 Disclaimers

  • Your use of the Platform is at your own risk
  • All implied conditions or warranties not explicitly included in these Terms are excluded to the maximum extent permitted by law

7.2 What We’re Not Responsible For

We are not liable for:
  • acts or omissions of Health Providers
  • appointment availability, timeliness or double bookings
  • no-show or late cancellation fees
  • maintaining or storing medical records
  • health fund rebate accuracy
  • denied claims or discrepancies
  • payment processing errors
  • Platform interruptions
  • viruses or harmful code
  • inaccurate or incomplete information on the Platform
  • any direct, indirect or consequential loss arising from your use of the Platform

7.3 Indemnity

You indemnify us for any loss or claim arising from your breach of these Terms.

7.4 Non-excludable Guarantees

Nothing in these Terms excludes or modifies rights under the Australian Consumer Law or similar laws that cannot be excluded.

8. Suspension or Termination of Access

  • We may suspend or terminate your access or Account at any time for any reason
  • Upon cancellation, your information may be deleted, de-identified or retained as permitted by law
  • Termination does not affect any accrued rights

9. General

9.1 Changes to These Terms

We may update these Terms by publishing an updated version on the Platform. The updated Terms apply from the date of publication.

9.2 Entire Agreement

These Terms constitute the entire agreement between you and us.

9.3 Severability

If any provision is invalid, the remainder continues in full effect.

9.4 No Waiver

Failure to enforce a right does not waive that right.

9.5 Assignment

You may not assign your rights under these Terms. We may assign ours without your consent.

9.6 Governing Law

These Terms are governed by the laws of New South Wales. You submit to the exclusive jurisdiction of NSW courts.

10. Definitions

Account — The account you create to access the Platform.
Health Fund — A private health insurance company participating in the claiming solution.
Health Provider — A healthcare provider offering services through the Platform.
Health Funding Partner — Third parties that provide health funding claim services through the Platform.
Health Funding Details — means any information or card details you provide to enable health-funding claims, rebates or related transactions through the Platform, including (as applicable) private health fund cards, Medicare cards or any other health funding details supported by the Platform from time to time.
Payment Processor — Third parties that process payments through the Platform.
Personal Data — Personal and health information as defined in the Privacy Act 1988 (Cth), including data relating to Platform transactions.
